Successful management and resolution of commercial real estate disputes

Having represented commercial and residential developers, investors, contractors, property management companies, both landlords and commercial tenants, Ken has seen every (ok, almost every) imaginable real estate dispute. Using his formidable analytical and management skills, for more than 12 years he acted as lead defense counsel and coordinated the efforts of multiple law firms to successfully defend the Michigan-based developers of a massive Las Vegas condominium conversion project against than 300 separate lawsuits seeking more than $260 million in damages; defeating class certification and protecting more than 99.6% of project profits. And when a Michigan tool & die company’s owner was fraudulently induced to plow the proceeds from the sale of his business into a portfolio of ill-conceived multi-family housing projects in Kentucky, Ken recruited local resources, negotiated a substantial discount on the client’s personal guaranty to the projects’ lender, over-saw the sale of some and the completion of other elements of the portfolio, and eventually helped the client obtain non-recourse financing and the eventual sale (at a substantial profit) of the balance. Which are only a few examples of his creative and practical approach to resolving real estate disputes.
